Terms of Service

• “Service” — The EthnicPath Virtual AI voice agent platform, including voice calling, SMS messaging, analytics, and related tools.
• “Client” / “You” — Any individual or organization that subscribes to and uses the Service.
• “Provider” / “We” — EthnicPath Research Inc., the operator of EthnicPath Virtual.
• “Voice Agent” — An AI-powered automated voice system deployed through the platform.

By accessing or using EthnicPath Virtual, you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service. We reserve the right to modify these terms at any time; continued use after changes constitutes acceptance.

EthnicPath Virtual provides AI-powered voice agents for automated calling, follow-ups, reminders, multilingual outreach, SMS messaging, and campaign management. The platform is designed primarily for market research firms, survey companies, and call center teams.

You agree to:

• Provide accurate and complete registration information
• Maintain the confidentiality of your account credentials
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized access

• Subscriptions are billed monthly in Canadian Dollars (CAD) plus applicable taxes (HST)
• Payments are processed securely through our PCI-DSS certified payment provider
• Each plan includes a set number of voice minutes per month; usage beyond the included allocation is billed at the plan's overage rate
• Subscription fees are non-refundable for the current billing period
• We reserve the right to adjust pricing with 30 days' written notice
• Failure to pay may result in account suspension or termination

You agree not to use the Service to:

• Engage in unlawful, fraudulent, or harassing communications
• Send unsolicited bulk messages or calls (spam)
• Violate any applicable telemarketing, do-not-call, or anti-spam laws (including CASL and TCPA)
• Impersonate any person or entity
• Interfere with or disrupt the Service's infrastructure
• Reverse-engineer, decompile, or attempt to extract the source code of the platform
• Resell, sublicense, or redistribute the Service without written consent

The Service is provided over internet infrastructure and is subject to factors outside our control, including internet connectivity, carrier routing, and recipient device compatibility. We do not guarantee uninterrupted or error-free service. AI voice agents may not perfectly replicate human conversation in all scenarios. See our Service Limitations page for detail.

All content, software, designs, and technology comprising the EthnicPath Virtual platform are the property of EthnicPath Research Inc. or its licensors. You retain ownership of your own data, campaign configurations, and content uploaded to the platform.

• You may cancel your subscription at any time; access continues through the end of the current billing period
• We may suspend or terminate accounts that violate these terms, with or without notice
• Upon termination, we retain the right to delete account data after a reasonable retention period

To the maximum extent permitted by law, EthnicPath Research Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Service. Our total liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

You agree to indemnify, defend, and hold harmless EthnicPath Research Inc. from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these terms, or infringement of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario, Canada.
